LG POLLS: PDP RELEASES GUIDELINES FOR CONDUCT OF ELECTION

The Peoples Democratic Party, Akwa Ibom State Chapter has Released the guideline for the conduct of local government election.
The Party Chairman, Obong Paul Ekpo made this known to press men in his office today.

The Sale of nomination form begins from 8th of September 2017 at party office, Uyo Akwa Ibom State.

While the Screening of aspirant will has been set for 9th and 10th of September

All Appeal cases will be heard on the 11th September 2017

Councilors Primaries has been set for the 12th September 2017 with Election of Ad-hoc delegates for party congresses which will elect Chairmanship candidates on the 13th of September.

GUIDELINES FOR THE 2017 LOCAL GOVERNMENT ELECTIONS

Pursuant to Article 7(3)(c); 50.7 – 50.8 of the Constitution of the Peoples Democratic Party, 2012 (as amended), the guidelines for the nomination of candidates to contest the forth coming Local Government Elections for the positions of Chairmen of Council and Councilors in the Local Government Areas and Wards respectively in Akwa Ibom State under the platform of the Peoples Democratic Party shall be as follows:

For the avoidance of doubt and for the purpose of emphasis, Article 7(3)(c) of the Party Constitution 2012 (as amended) provided thus: “The Party shall pursue these aims and objectives by adhering to the policy of the rotation and zoning of the Party and public elective offices in pursuance of the principle of equity, justice and fairness”.

ELIGIBILITY: Any aspirant contesting for the Chairmanship and Councillorship Primaries must possess the following qualifications:

Such aspirant apart from being a Nigerian citizen by birth must be a card carrying and financial member of the Peoples Democratic Party and also a registered voter.

An aspirant for the position of a Chairman shall be a person of not less than 30 years of age and must possess a minimum qualification of School Certificate level or its equivalent with at least 5 credits including English language obtained at not more than 2 sittings. Other higher educational qualifications will be of added advantage.

An aspirant for the position of a Councilor must not be less than 25 years of age and must be educated up to at least the School Certificate level or its equivalent.

Any aspirant who is presently an Executive Member of the Peoples Democratic Party at any level or a political appointee who intends to contest the primary for either the office of the Chairman or Councilor, must resign from such position not later than 30 days to the date of the election.

PROCEDURE TO BE FOLLOWED BY ALL ASPIRANTS

All aspirants for the office of Chairman or Councilor shall obtain Expression of Interest and Nomination forms from the Peoples Democratic Party State Secretariat at Edet Akpan Avenue, Uyo, Akwa Ibom State.

Aspirants for the office of Chairman shall purchase Expression of Interest and Nomination Forms at the price of ₦100,000.00 (One Hundred Thousand Naira) only and ₦400,000.00 (Four Hundred Thousand Naira) only respectively.

Aspirants for the office of Councilor shall purchase Expression of Interest and Nomination Forms at the price of ₦50,000.00 (Fifty Thousand Naira) only and ₦100,000.00 (One Hundred Thousand Naira) only respectively.

In line with the Peoples Democratic policy of gender equality, and the conscious desire of the leadership of the party at all levels to enhance the status to the women in the society and also afford them the opportunity to aspire to elective positions, the leader of Peoples Democratic Party and the Executive Governor of Akwa Ibom State, Mr. Udom Gabriel Emmanuel have directed that the State Executive Committee of the party rant special concession to every woman aspirant to the position of Chairman and Councilor. To this end, all women aspirants for the offices of Chairman and Councilor shall pay for the Expression of Interest Form only but obtain the Nomination Form for the primaries free of charge.

All payments for the Expression of Interest and Nomination Forms shall be made into the party’s account, namely ——– The original copy of the teller obtained from the Bank shall be used for the collection of forms.

Chairmanship aspirants shall be nominated by twenty (20) registered voters from at least two-thirds of all the wards within his/her Local Government Area and who are registered financial members of the Party.

Councillorship aspirants shall be nominated by twenty (20) registered voters from at least two-thirds of all the units or villages within his/her Ward and who are registered financial members of the Party.

The duly completed Nomination Form shall be accompanied by a sworn declaration by the aspirant made before a Commissioner for Oaths or Notary Public undertaking to abide by the guidelines and any rules or regulations relating to the conduct of the primary elections issued by the Party.

CONDUCT OF PRIMARIES

CHAIRMANSHIP PRIMARY: The following persons are eligible to vote in the Local Government Chairmanship Primary;

The Chapter Chairman of the Party and other members of the Local Government Area Executive Committee.

All National, Zonal and State Executive Committee members of the Party from the Local Government Area.

All members of the National and State House of Assembly from the Local Government Area, who are members of the Party.

Members of the Board of Trustees of the Party from the Local Government Area.

All Chairmen and Secretaries of the Ward.

Three delegates from each ward of the Local Government Area elected at the Ward Congress at least one of whom shall be a woman, all of whom shall cease to function at the conclusion of the Primaries for which they were elected.

All elected political office holders from the Local Government Area who are members of the Party, that is:

(i) The President of the Federal Republic of Nigeria.

(ii) The Vice President of the Federal Republic of Nigeria.

(iii) The State Governor.

(iv) The Deputy Governor

Former Members of the National Assembly who are still members of the Party.

Former State House of Assembly members who are still members of the Party.

Former State Officers of the Party who are still members of the Party.

Former National Executive Members of the Party who are still members of the Party.

Former Peoples Democratic Party Chapter Chairmen and their Secretaries who are still members of the Party.

Former Local Government Chairmen and Vice Chairmen elected on the Platform of the Party who are still members of the Party.

Former Leaders of the Local Government Legislature elected on the platform of the Party who are still members of the Party.

COUNCILLORSHIP PRIMARY: The persons eligible to vote in the Councillorship Primaries shall be registered members of the Party in the Ward whose name is in the membership register of the Party and who are duly accredited for the exercise by the Returning Officer appointed by the Party to conduct the primary in the said Ward.

ACCREDITATION/VOTING

CHAIRMANSHIP
(i) On the day of the Chairmanship Primaries, the Returning Officer appointed by the State Executive Committee of the Party shall conduct accreditation exercise based on the approved delegate lit between the hours of 8.00 am and 12.00 noon.
(ii) At the end of the accreditation exercise, the number of delegates accredited shall be announced publicly before commencement of the election.
(iii) The names of the aspirants shall be announced to the hearing of all present.
(iv) Voting shall commence immediately and at the end of voting, the result shall be openly counted and result announced. The result, as announced, shall be entered in the appropriate forms meant for the exercise.
(v) The refusal, neglect or failure of an aspirant or his agent to sign the result sheet shall not invalidate the result of the primary election.
(vi) A copy of the result shall be given to each aspirant or his/her agent but failure or refusal to collect the result shall not invalidate the result contained therein.
(vii) Venue for the Chairmanship Primaries shall be the Local Government headquarters.

COUNCILLORSHIP

(i) On the day of the Chairmanship Primaries, the Returning Officer appointed by the State Executive Committee of the Party shall conduct accreditation exercise based on the approved delegate lit between the hours of 8.00 am and 12.00 noon.

ESTABLISHMENT OF COMMITTEES/RESPONSIBILITIES

THE SCREENING AND VERIFICATION COMMITTEE: This Committee is saddled with the responsibility to screen all aspirants to ensure the eligibility to screen all aspirants to ensure the eligibility to contest the primaries and verify documents such as academic credentials, tax clearance certificate, party membership and voters card etc.

SCREENING APPEAL COMMITTEE:
(i) Any aspirant dissatisfied with the decision of the Screening and Verification Committee may appeal against such decision to the Screening Appeal Committee within 24 hours from the time of receipt of the result of the screening.
(ii) The Screening Appeal Committee shall pronounce its decision on an appeal within 48 hours or so soon thereafter.
(iii) Only aspirants cleared by the Screening and Verification Committee or whose appeal is upheld by the Screening Appeal Committee shall be allowed to participate in the primary elections.
(iv) The decision of the Screening Appeal Committee in all petitions addressed to it shall be final.
STATE ELECTORAL PANEL:
(i) For the smooth and efficient conduct of the Chairmanship and Councillorship Primaries, the State Electoral Panel is hereby established by the State Executive Committee of the Party.
(ii) The State Electoral Panel shall appoint Returning/Electoral Officers for the Chairmanship and Councillorship primaries and the Returning Officers shall be deployed to Local Government Areas and Wards other than their own.
INELIGIBILITY/DISQUALIFICATION: An aspirant shall not be qualified to contest the Chairmanship and Councillorship Primaries, if he/she:

(i) Fails to produce his personal income tax certificate or any evidence that he/she paid his/her income tax for the last preceding three years or evidence of exemption from payment of personal income tax; or

(ii) Present a false birth certificate or declaration of age; or

(iii) Has been convicted by a court of competent jurisdiction of any criminal offence involving homicide, fraud or dishonesty or the sale or use of narcotic drugs or any other psychotropic substances by any court of competent jurisdiction in Nigeria or within the commonwealth or elsewhere; or

(iv) Has been dismissed from the Public Service of the Federation or of a State or Local Government or from any other employment in public or private sector; or

(v) Is a member of a Secret Society; or

(vi) Has been adjudged guilty of treason or treasonable felony by any court in Nigeria; or

(vii) Has been convicted for embezzlement or fraud by a court of competent jurisdiction; or

(viii) Under the law in any part of Nigeria, he is adjudged to be a lunatic or otherwise declared declared to be of unsound mind; or

(ix) Is an undischarged bankrupt, having been adjudged or otherwise declared bankrupt under any law in force in Nigeria or any other country; or

(x) Has not attained 2 (two) years as a registered member of the Party unless the appropriate Party Executive Committee rules to the contrary (waiver).
7.0 GENERAL PROVISIONS
(a) Any officer or member of the Party who fails, refuses or neglects to carry out his duties in relation to these guidelines on the general conduct of the primary elections or who obstructs, flouts, or in any manner hinders, impedes or subverts the implementation or success of these Guidelines is guilty of gross misconduct and shall be brought before the State Disciplinary Committee of the Party for disciplinary action.

(b) Under no circumstance shall an elected official of the Party, at any level, be appointed to perform the job of an agent of any aspirant.

(c) It is mandatory for every Returning Officer involved in the Primary elections to submit the result to the State Electoral Panel and the State Executive Panel and the State Executive Committee within 24 hours of the announcement of results.

(d) Where it is not conducive by reason of insecurity or otherwise for the conduct of the primary election in any Local Government headquarters or Ward Centres, the State Executive Committee of the Party reserves the right to change the venue to any other location within the State.

(e) All aspirants are advised to comply strictly with the requirements as stipulated and provided in the Expression of Interest and Nomination Forms.

(f) Aspirants are advised to ensure that their agents are registered members of the Peoples Democratic Party as well as registered voters with valid membership and Voters Cards.

(g) Where there is only one aspirant, election shall nevertheless be held to confirm the nomination of the aspirant and in the case, there shall be the number of “no” votes and the “yes” votes.

The aspirant with the hifhest votes cast shall be declared winner and returned immediately after the election by the Returning Officer. Where no winner emerges at the end of the first ballot by reason of a tie, there shall be a run-off election between aspirants whose votes tie and the aspirant with a simple majority of the votes cast during the run-off shall be returned elected.

Notwithstanding the provisions of these guidelines and any other rules or regulations laid down by the Party, the decision of the State Executive Committee as advised by the State Electoral Panel shall be final and binding on the aspirants, officers and organs of the Party in respect of the primary election.

Every Aspirant for Chairmanship and Councillorship election shall be eligible to vote whether or not as in the case of Chairmanship Primary, he was elected as a ward delegate.

“Registered/Financial Member” of the Party means that both the Candidate and the nominator must show evidence of payment of annual dues levies on the Party Membership Card.
